Alexander Nicholas Gallery operates this website and online store, including all related information, content, artwork, product pages, features, tools, products, and services offered through the site.

By visiting, browsing, interacting with, or purchasing from this website, you agree to be bound by these Terms of Service, our Privacy Policy, Shipping Policy, and Return, Exchange, and Cancellation Policy.

Please read these Terms carefully before using this website or placing an order. If you do not agree to these Terms, you should not access or use this website.

1. Use of This Website

You may use this website for lawful, personal, non-commercial purposes only. You agree not to use this website in any way that violates applicable law, infringes upon the rights of others, interferes with the operation of the website, or attempts to gain unauthorized access to any portion of the website or related systems.

You may not use this website to transmit viruses, malware, spam, automated scraping tools, unauthorized data extraction tools, or any other harmful code or activity.

We reserve the right to suspend, restrict, or terminate access to this website at any time if we believe a user has violated these Terms or engaged in conduct that may harm Alexander Nicholas Gallery, its customers, its artwork, or its services.

2. Account and Customer Information

You may be asked to provide certain information when placing an order, creating an account, or contacting us, including your name, email address, billing information, shipping information, and payment details.

You agree that all information you provide is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity associated with your account.

Alexander Nicholas Gallery is not responsible for delays, delivery issues, or failed communications caused by inaccurate, incomplete, or outdated customer information.

3. Artwork and Product Information

Alexander Nicholas Gallery offers conceptual photographic artwork created by Alexander Nicholas. Artwork may be offered in different presentations, including LumaChrome Fine Art Prints and Optical Grade Acrylic Facemount editions.

We make every effort to accurately display artwork images, product descriptions, dimensions, materials, pricing, edition information, and production details. However, digital images shown on the website are representations only.

Actual color, contrast, brightness, scale, surface appearance, and overall presentation may vary slightly due to screen settings, device displays, lighting conditions, production processes, materials, and selected presentation type. Such variations are not considered defects.

Product descriptions, pricing, sizes, presentations, availability, and edition information may be updated or changed at any time without prior notice.

4. Editions and Certificates of Authenticity

LumaChrome Fine Art Prints are offered as Open Editions unless otherwise stated.

Optical Grade Acrylic Facemount editions are offered as Limited Editions unless otherwise stated. Limited Edition quantities are specific to the presentation and collection described on the applicable product page.

Each Optical Grade Acrylic Facemount includes a signed Certificate of Authenticity verifying the artwork title, artist, production method, and individual edition information.

Certificates of Authenticity may ship separately from the artwork for security and documentation purposes.

5. Orders

When you place an order through this website, you are making an offer to purchase the selected artwork or product. Alexander Nicholas Gallery reserves the right to accept, decline, cancel, or modify an order for any reason, including suspected fraud, pricing errors, product availability, shipping limitations, or other circumstances affecting fulfillment.

Your order is not accepted until payment is processed and an order confirmation is issued.

Please review all order details carefully before submitting your purchase, including artwork title, size, presentation, shipping address, billing information, and contact information.

Because each artwork is produced to order, cancellation or modification requests may not be available once production begins.

6. Made-to-Order Production

Each Alexander Nicholas artwork is produced to order. Production does not begin until an order has been placed and accepted.

LumaChrome Fine Art Prints are produced to order and typically require approximately 14–18 days from the date of order before shipment.

Optical Grade Acrylic Facemount editions are produced to order, professionally face-mounted, and crated for shipment. Production typically requires approximately 4–6 weeks from the date of order before shipment.

Production times are estimates only and may vary based on order volume, selected presentation, production schedule, packaging requirements, carrier availability, and circumstances outside our control.

7. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated.

Prices, discounts, promotions, shipping charges, taxes, and product availability are subject to change without notice. The price charged for an order will be the price displayed at checkout at the time the order is placed, subject to correction of errors, inaccuracies, or omissions.

Unless expressly stated otherwise, posted prices may not include taxes, shipping, handling, duties, customs charges, import fees, or other charges that may apply based on destination or order details.

You agree to provide current, complete, and accurate payment and billing information. By submitting payment information, you represent that you are authorized to use the selected payment method.

8. Shipping and Delivery

Each artwork is professionally packaged for shipment.

LumaChrome Fine Art Prints are shipped rolled in a protective tube.

Optical Grade Acrylic Facemount editions are professionally crated for shipment. Larger works may require specialized handling or freight delivery.

Tracking information is provided once the artwork has shipped.

Delivery times vary depending on destination, selected presentation, packaging requirements, carrier availability, production schedule, and other factors outside our control.

For orders within the contiguous United States, delivery typically takes approximately 4–6 weeks from the time of purchase.

Orders shipped outside the contiguous United States, including Alaska, Hawaii, and international destinations, may require 6–8 weeks or longer depending on destination, customs processing, packaging requirements, and carrier availability.

Alexander Nicholas Gallery is not responsible for delays caused by production partners, carriers, freight providers, customs processing, weather, incorrect shipping information, failed delivery attempts, recipient unavailability, or events outside our control.

9. Shipping Damage

If artwork arrives damaged, please contact us within 48 hours of delivery at alexandernicholasgallery@gmail.com.

Please include your order number, photos of the damaged artwork, photos of the packaging, photos of the shipping label, and a brief description of the issue.

All original packaging materials must be retained until the claim process is complete, as the carrier may require inspection.

Failure to report damage within the required time period or failure to retain packaging materials may affect the ability to process a claim or provide a resolution.

If a damage claim is approved, Alexander Nicholas Gallery will work with the production and shipping partners to determine the appropriate resolution, which may include repair, replacement, or another appropriate remedy.

10. Returns, Exchanges, and Cancellations

Each Alexander Nicholas artwork is produced to order. Because each artwork is custom produced after purchase, all LumaChrome Fine Art Prints and Optical Grade Acrylic Facemount editions are final sale once production begins.

Made-to-order artwork cannot be returned or exchanged due to buyer’s remorse, changes in preference, incorrect size selection, or a decision to select a different artwork after purchase.

Because production may begin shortly after an order is placed, cancellation or modification requests are not guaranteed.

If a cancellation or order change is requested after production has begun, Alexander Nicholas Gallery reserves the right to deny the request or apply a restocking, production, or cancellation fee of up to 50% of the purchase price.

Once an artwork has been produced or shipped, the order cannot be cancelled, returned, exchanged, or refunded except in cases of verified damage, defect, or fulfillment error.

11. Incorrect Shipping Information

Collectors are responsible for providing accurate shipping information at checkout.

Alexander Nicholas Gallery is not responsible for delays, misdelivery, failed delivery, returned shipments, additional shipping charges, or other delivery issues caused by incorrect or incomplete shipping information.

If an order must be reshipped due to incorrect customer-provided information, the customer may be responsible for additional shipping, handling, crating, or carrier charges.

12. Intellectual Property

All artwork, images, photography, designs, text, graphics, logos, product descriptions, website content, videos, audio, and other materials displayed on this website are owned by Alexander Nicholas Gallery, Alexander Nicholas, its affiliates, or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, download, screenshot for commercial use, distribute, modify, create derivative works from, publicly display, publicly perform, publish, transmit, sell, license, exploit, or otherwise use any artwork or website content without prior written permission from Alexander Nicholas Gallery.

Purchasing artwork does not transfer copyright, reproduction rights, licensing rights, commercial use rights, or any other intellectual property rights to the buyer.

All rights not expressly granted are reserved.

13. Trademarks

Alexander Nicholas Gallery, Alexander Nicholas, related logos, artwork titles, collection names, product names, designs, slogans, and branding elements may be trademarks, trade names, or protected brand identifiers of Alexander Nicholas Gallery or Alexander Nicholas.

You may not use these names, marks, logos, or branding elements without prior written permission.

All other trademarks, service marks, product names, company names, or logos appearing on the website are the property of their respective owners.

14. Prohibited Uses

You agree not to use this website or its content:

For any unlawful purpose
To violate any applicable law or regulation
To infringe upon or violate our intellectual property rights or the rights of others
To copy, scrape, reproduce, or commercially exploit artwork or website content

To the fullest extent permitted by law, Alexander Nicholas Gallery disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, accuracy, and non-infringement.

We do not guarantee that the website will be uninterrupted, secure, error-free, or free from viruses or harmful components.

Some jurisdictions do not allow certain limitations or exclusions of warranties, so some of these exclusions may not apply to you.

To the fullest extent permitted by law, Alexander Nicholas Gallery’s maximum liability for any claim related to a purchased product shall not exceed the amount actually paid by you for that product.

You agree to indemnify, defend, and hold harmless Alexander Nicholas Gallery, its owners, affiliates, partners, employees, contractors, service providers, licensors, and representatives from any claims, losses, damages, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising out of your violation of these Terms, misuse of the website, violation of law, infringement of rights, or use of purchased artwork beyond the rights granted.
